The terms governing use of the SiteDay website, SaaS platform and mobile applications.

These Terms of Service ("Terms") govern the use of the SiteDay website, software platform, and mobile applications (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. About SiteDay

SiteDay is a cloud-based field service management platform designed to help organisations manage engineers, jobs, service visits, assets, and maintenance activity.

2. Accounts

To use the Service, you must create an account or be granted access by an organisation using SiteDay. Users agree to provide accurate information, maintain the security of their credentials, and notify their organisation or SiteDay if unauthorised access is suspected.

3. Organisation Accounts

Organisations using SiteDay are responsible for managing their user accounts, authorising access, and maintaining the accuracy of data entered into the platform.

4. Subscription and Billing

Certain features of the Service may require a paid subscription. Subscription pricing, limits, and billing terms are provided at the point of purchase. Payments may be processed by third-party payment providers. Failure to pay fees when due may result in suspension or restriction of the Service.

5. Acceptable Use

Users must not misuse the Service, attempt unauthorised access, upload malicious software, interfere with platform operations, or use the platform for unlawful purposes.

6. Customer Data

Organisations using SiteDay may store customer information, site data, job records, service history, photographs, and related documentation within the platform. This data remains the responsibility of the organisation that enters it.

7. Customer Data Ownership

Organisations using SiteDay retain ownership of all data they enter into the Service ("Customer Data"). Customer Data may include customer contact details, site addresses, job records, service history, asset records, photographs, and uploaded documentation.

SiteDay Software Ltd does not claim ownership of Customer Data. Organisations are solely responsible for ensuring they have the legal right to collect, store, and process any personal or operational data entered into the platform. SiteDay processes Customer Data only for the purpose of providing the Service and operating the platform on behalf of the organisation using the system.

Organisations remain responsible for the accuracy, legality, and integrity of data stored within their account.

8. Intellectual Property

All intellectual property relating to SiteDay, including software, branding, design, and documentation, remains the property of SiteDay Software Ltd. Users are granted a limited, non-exclusive licence to use the Service for its intended purpose.

9. Service Availability

We aim to provide reliable access to the platform, but we do not guarantee uninterrupted availability. Maintenance, updates, and technical issues may occasionally affect access.

10. Mobile Applications

SiteDay mobile applications are provided to allow authorised users to access the platform while in the field. Use of the applications may require internet access and device permissions such as location or camera access.

11. Limitation of Liability

To the fullest extent permitted by law, SiteDay Software Ltd shall not be liable for any indirect, incidental, or consequential loss arising from use of the Service, including loss of data, loss of business, or operational disruption. The Service is provided on an "as available" basis.

12. Termination

Organisations may cancel their subscription in accordance with the applicable billing terms. SiteDay may suspend or terminate access where these Terms are violated, payment obligations are not met, or unlawful activity is suspected.

13. Changes to the Service

We may update, improve, or modify the Service over time. New features or changes may be introduced to improve functionality and security.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes have been published constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales.
